This Privacy Policy explains how Monarch Vision Properties L.L.C (operating as βAqarSouqβ) collects, uses, stores, and shares your personal data when you visit aqarsouq.ae, list a property, register an account, or interact with our agents. We comply with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the βPDPLβ) and the executive regulations issued thereunder.
1. Who we are
AqarSouq is operated by Monarch Vision Properties L.L.C, a UAE limited-liability company with trade license 1567775 issued by the Department of Economic Development, Dubai, and a Dubai Land Department (DLD) Real Estate Regulatory Agency (RERA) broker office number (ORN) 56909. We act as the Data Controller for personal data processed through the AqarSouq platform.
2. Data we collect
We collect three categories of data:
- Information you provide: name, email, phone, password (hashed), passport / Emirates ID (for verified agent accounts), RERA / BRN number, employer, profile photo, property listing content, photos, virtual tour links, EOI / inquiry messages.
- Information collected automatically: IP address, device, browser, pages viewed, referring URL, search queries, click events, approximate geo-location derived from IP, cookies (see Cookie Policy).
- Information from third parties: Dubai Land Department public transaction data, RERA / ADREC permit verification responses, identity-verification providers, payment processors (only the metadata they return β we never store full card numbers).
3. How we use data
- To provide the platform: show listings, route inquiries to agents, calculate market analytics, generate AqarIQ locality scores.
- To verify regulatory compliance: validate DLD Trakheesi / ADREC Madhmoun permits, RERA BRN numbers.
- To send transactional emails / WhatsApp messages (booking confirmations, EOI receipts, admin alerts).
- To send marketing emails β only with your explicit opt-in via our newsletter form, with unsubscribe in every email.
- To detect fraud, abuse, scrape-bots, and to enforce our Terms.
- To comply with legal obligations (court orders, regulator requests, anti-money-laundering requirements).
4. Legal basis under the UAE PDPL
We process personal data only when one of the lawful bases set out in Article 4 of the PDPL applies:
- Consent β for marketing emails, optional preference fields, and non-essential cookies.
- Contractual necessity β to provide the services you sign up for.
- Legitimate interest β to operate, secure, and improve the platform, subject to the balancing test required by the PDPL.
- Legal obligation β to comply with Dubai Land Department, RERA, ADREC, AML, tax, and other UAE laws.
6. Dubai Land Department / RERA compliance & liability
AqarSouq is an online information services platform. It is not a party to any property sale, purchase, lease, or escrow transaction. All property transactions in the Emirate of Dubai must be:
- Advertised under a valid DLD Trakheesi permit (a 10-digit number starting with 71) β we surface this prominently on every Dubai listing.
- Brokered by a RERA-registered agent with a valid BRN, employed by an ORN-licensed brokerage.
- Registered with the Dubai Land Department in accordance with Dubai Law No. 7 of 2013 and the Strata Law.
Limitation of AqarSouq's role: AqarSouq does not act as a broker, principal, escrow agent, valuer, or guarantor. Property descriptions, photos, prices, AqarIQ scores, market estimates, mortgage calculations, ROI projections, and any other content on the platform are provided for general information only and are not financial, investment, tax, or legal advice. Buyers and tenants must conduct their own due diligence, including verifying:
- The Trakheesi or Madhmoun permit on dubailand.gov.ae or via the Dubai REST app / DARI portal.
- The seller's title deed and any encumbrances at the Dubai Land Department.
- The broker's BRN status with RERA and the brokerage's ORN status.
- Independent valuation and legal title checks before signing any MoU, Form F, or contract.
Liability coverage: To the maximum extent permitted by UAE law, AqarSouq's total aggregate liability arising out of or in connection with the use of the platform is limited to AED 5,000 (United Arab Emirates Dirhams five thousand) per claim and AED 25,000 in aggregate over any 12-month period. AqarSouq is not liable for:
- Inaccuracies, omissions, or fraudulent content submitted by third-party agents or developers.
- The legality, suitability, condition, or true value of any listed property.
- Losses arising from a buyer's, seller's, or tenant's reliance on AqarIQ scores, market analytics, mortgage / ROI calculators, or any AI-generated content.
- Disputes between users and third-party agents, brokerages, developers, banks, escrow providers, or government bodies.
- Indirect, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.
Nothing in this Policy excludes or limits any liability that cannot be excluded or limited under UAE federal law (including liability for fraud, gross negligence, or wilful misconduct).
7. Retention
We retain personal data only for as long as necessary for the purposes for which it was collected:
- Account data β for the life of the account plus 24 months after closure.
- Transaction-related records β 7 years, in line with UAE commercial law and DLD record-keeping practice.
- Marketing data β until you unsubscribe.
- Server logs β 12 months.
8. International transfers
Some of our service providers (e.g. cloud hosting, AI providers, analytics) process data outside the UAE. We rely on the safeguards permitted by Articles 22β23 of the PDPL β adequacy decisions issued by the UAE Data Office, contractual safeguards equivalent to the EU Standard Contractual Clauses, or your explicit consent.
9. Your data rights
Under the UAE PDPL you have the right to:
- Be informed about the processing of your data (this Policy).
- Access the data we hold about you.
- Correct inaccurate or incomplete data.
- Erase your data, subject to legal retention obligations.
- Restrict or object to processing.
- Withdraw consent at any time, where consent is the legal basis.
- Receive your data in a portable, machine-readable format.
- Lodge a complaint with the UAE Data Office.

10. Security
We protect personal data with industry-standard safeguards: TLS 1.2+ in transit, encryption at rest, hashed passwords (bcrypt), role-based access controls, audit logs, and regular security reviews. No system is perfectly secure; we will notify affected users and the UAE Data Office of any qualifying personal-data breach without undue delay, in line with PDPL Article 9.
11. Children
The platform is not directed to persons under the age of 18. We do not knowingly collect personal data from minors. If you believe a minor has provided us data, contact us and we will delete it.
12. Changes to this policy
We may update this Policy from time to time. Material changes will be notified via a banner on aqarsouq.ae and by email to registered users at least 14 days before they take effect. The "Last updated" date at the top of this page always reflects the current version.
