Template notice: This document is a working template prepared in good faith and aligned with UAE Federal Decree-Law No. 45 of 2021 (PDPL), Dubai Law No. 7 of 2013 (RERA / Land Department), and standard ICC e-commerce practice. These Terms of Service (the “Terms”) govern your access to and use of the AqarSouq platform at aqarsouq.ae and its sub-domains, mobile apps, and APIs (collectively, the “Platform”). The Platform is operated by Monarch Vision Properties L.L.C (“AqarSouq”, “we”, “us”). By accessing or using the Platform you agree to be bound by these Terms.

1. Acceptance

By creating an account, listing a property, sending an inquiry, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under UAE law to use the Platform. Agents and brokerages must hold valid registrations with the Real Estate Regulatory Agency (RERA) of the Dubai Land Department and / or the Abu Dhabi Real Estate Centre (ADREC), as applicable.

3. Accounts, agents, and verification

You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. Agent accounts go through an admin verification step. Until your RERA BRN and brokerage ORN are verified, your listings will not be publicly searchable.

You agree not to share your password or transfer your account. Notify us immediately at legal@aqarsouq.ae of any suspected unauthorised access.

4. Property listings — accuracy & responsibility

Agents and sellers who upload listings represent and warrant that:

  • They have the legal right and the owner's authorisation to advertise the property.
  • All content (text, photos, virtual tours, prices, payment plans) is accurate, up to date, and not misleading.
  • Any AI-enhanced images and AI-rewritten descriptions remain truthful representations of the property.
  • They will remove the listing or update its status within 24 hours of the property being sold, leased, or withdrawn.

AqarSouq does not independently verify the truth of each listing. Buyers and tenants are responsible for their own due diligence (see Section 6).

5. RERA, ADREC, and DLD advertising-permit compliance

Every property advertised on the Platform that is located in Dubai must carry a valid DLD Trakheesi advertising permit (10-digit identifier starting with "71"), obtained via dubailand.gov.ae before the listing is made public. Every property located in Abu Dhabi must carry a valid ADREC Madhmoun permit issued via the DARI portal.

We display each permit prominently on the property detail page. Listings without a valid permit are placed in a 7-day grace window during which the agent must add the permit number; after the grace window expires, non-compliant listings are automatically hidden from public search.

You agree that submitting a fake, expired, or someone else's permit number is a material breach of these Terms and grounds for immediate account termination, removal of all your listings, and reporting to the relevant regulator.

6. Role of AqarSouq — information services platform

The Platform is an information services platform that connects buyers, tenants, and investors with RERA / ADREC-registered agents. AqarSouq:

  • Is not a real-estate broker, principal, agent, valuer, escrow agent, lender, or insurer.
  • Is not a party to any contract entered into between users and third parties.
  • Does not hold or transfer client funds. All payments for property, deposits, and broker commissions flow directly between the parties through DLD-approved channels.
  • Provides AqarIQ scores, market analytics, mortgage / ROI calculators, and AI features for general information only. Numbers are derived from public DLD data and proprietary models; they are estimates, not guarantees.

You agree to conduct your own due diligence before signing any binding document — including verifying the seller's title deed at DLD, the agent's BRN status with RERA, and the brokerage's ORN status; obtaining independent legal and tax advice; and commissioning an independent property valuation.

7. No financial, legal, or tax advice

Content on the Platform — including AqarIQ scores, "deal score" badges, market intelligence charts, mortgage calculators, ROI / yield projections, and AI Concierge / Deal Finder outputs — is provided for general information only. It does not constitute financial, investment, legal, tax, or other professional advice and must not be relied upon as such. Seek independent advice from a UAE-licensed professional before making any decision.

8. Fees, subscriptions, and refunds

Browsing public listings is free. Some agent / brokerage features (premium listings, AqarIQ Pro, the Designer Pro tools, future Stripe subscriptions) require payment. We will display all fees and taxes (including UAE 5% VAT, where applicable) before you confirm. Refund eligibility, if any, is disclosed at the point of purchase. Disputed charges should be raised with us within 14 days at billing@aqarsouq.ae.

9. Intellectual property

The Platform, including its source code, design, AqarIQ algorithms, content (excluding user-submitted listings), brand, and logo, is owned by Monarch Vision Properties L.L.C and protected by UAE and international intellectual-property laws. You may not copy, modify, scrape, reverse-engineer, or commercially exploit any part of the Platform without our prior written consent. Agents and sellers grant AqarSouq a non-exclusive, royalty-free, worldwide licence to host, display, and promote the content they upload for the duration of their listing.

10. Prohibited uses

You agree NOT to:

  • Submit fake, misleading, or duplicate listings.
  • Submit listings without a valid Trakheesi / Madhmoun permit (when required).
  • Impersonate another agent, owner, or person.
  • Scrape, harvest, or otherwise extract data from the Platform at scale without our written consent.
  • Use the Platform for money-laundering, terrorist financing, or any other unlawful purpose.
  • Upload viruses, malware, or any code that interferes with the Platform.
  • Discriminate against users on the basis of nationality, religion, gender, or any other ground protected by UAE law.

11. Limitation of liability — Dubai Land Department & general

To the maximum extent permitted by UAE law:

  • The Platform is provided "as is" and "as available", without warranties of any kind, express or implied.
  • AqarSouq does not warrant the accuracy, completeness, or currency of any listing, permit number, AqarIQ score, market estimate, mortgage calculation, ROI projection, or AI-generated content.
  • AqarSouq is not liable for any losses arising from (a) inaccurate or fraudulent third-party listings, (b) the conduct of agents, brokerages, developers, banks, or government bodies, (c) loss of profits, business interruption, or lost data, or (d) force-majeure events.
  • Where liability cannot be excluded, AqarSouq's total aggregate liability to any user arising out of or in connection with the Platform is limited to AED 5,000 per claim and AED 25,000 in aggregate over any 12-month period.

Nothing in these Terms excludes liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be excluded under UAE federal law.

12. Indemnity

You agree to indemnify and hold harmless Monarch Vision Properties L.L.C, its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of (i) your breach of these Terms, (ii) your violation of any law or third-party right, or (iii) any content you submit to the Platform.

13. Suspension & termination

We may suspend or terminate your account, remove any listing, or block your access to the Platform at any time, without notice, if we reasonably believe you have breached these Terms, violated applicable law, or posed a risk to other users or to the Platform. You may close your account at any time by emailing legal@aqarsouq.ae; sections 9, 11, 12, and 14 survive termination.

14. Governing law & dispute resolution

These Terms are governed by the federal laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Dubai International Financial Centre (DIFC) Courts, unless mandatory law requires otherwise. Before commencing proceedings, the parties agree to attempt good-faith resolution by negotiation for 30 days.
